Construction Injury Case Monroe County Steve Foley Esq

Rochester, NY

Construction Accident

Tom, age 46, a laborer working on the construction of a new fast food restaurant, fell six feet from a scaffold and was injured due to the property owner and general contractor's failure to provide adequate fall protection in violation of NYS's labor laws. Tom sustained various injuries to his right shoulder and elbow. His persistent pain led him to see his chiropractor two days later. Upon evaluation, Tom was diagnosed with a rotator cuff tear and an ulnar nerve injury, both which required surgery. As a result, Tom would not be able to return to full time heavy labor. A jury verdict close to $1,730,000 helped to compensate Tom for his past and future wages, allowing him the financial security to move ahead and retrain for a light duty job.

He ultimately underwent neck surgery. Despite the existence of some pre-existing arthritis, the jury unanimously found that the collision was the cause of Brian's herniated disc and subsequent cervical spine fusion surgery. Although Brian continued to be able to work for the NYS Department of Transportation, he was no longer able to to participate in many of the activities he used to enjoy,  particularly those activities with stepson who suffered multiple sclerosis.

Workplace Fall 1.95 Million Verdict Steve Foley Esq Erie County

Lancaster, NY

Workplace FALL

Russ, a 60 year old delivery truck operator, suffered injuries in an unwitnessed fall as he was in the process of making a delivery. Russ was injured when he fell out of the back of his delivery van while attempting to free a defective pallet jack lodged beneath an improperly staged delivery. This case was particularly difficult for Russ because no one witnessed his fall and the back injuries which he sustained, required surgery. The defense argued that these types of injuries and conditions were a result of prior heavy labor  and not the injury. After two weeks of trial, a jury returned a unanimous verdict for Russ in the amount of $1,950,000 and gave Russ the financial security he required moving forward, in light of his inability to ever return to work.
