$4.5 Million Settlement: Motorcycle Accident/Wrongful Death In Buffalo, New York

$3.15 Million: Highway Collision In Boston

Brian, a New York State Department of Transportation employee, was operating a snowplow on the thruway when a tractor-trailer driver negligently attempted to pass him on the right. Subsequently, colliding with a portion of Brian’s vehicle. Although Brian was able to maintain control of the snowplow, he was forcibly shaken and sustained a herniated disc in his neck. He ultimately underwent neck surgery. Despite the existence of some preexisting arthritis, the jury unanimously found that the collision was the cause of Brian’s herniated disc and subsequent cervical spine fusion surgery. Although Brian continued to be able to work for the NYS Department of Transportation, he was no longer able to participate in many of the activities he used to enjoy, particularly those activities with his stepson who suffered multiple sclerosis.

$1.95 Million: Fatal Workplace Fall In Lancaster, New York

Russ, a 60-year-old delivery truck operator, suffered injuries in an unwitnessed fall as he was in the process of making a delivery. Russ was injured when he fell out of the back of his delivery van while attempting to free a defective pallet jack lodged beneath an improperly staged delivery. This case was particularly difficult for Russ because no one witnessed his fall and the back injuries which he sustained required surgery. The defense argued that these types of injuries and conditions were a result of prior heavy labor and not the injury. After two weeks of trial, a jury returned a unanimous verdict for Russ in the amount of $1.95 million and gave Russ the financial security he required moving forward, in light of his inability to ever return to work.

$1.73 Million: Construction Injury In Rochester, New York

Tom, age 46, a laborer working on the construction of a new fast-food restaurant, fell six feet from a scaffold and was injured due to the property owner and general contractor’s failure to provide adequate fall protection in violation of New York Labor Laws. Tom sustained various injuries to his right shoulder and elbow. His persistent pain led him to see his chiropractor two days later. Upon evaluation, Tom was diagnosed with a rotator cuff tear and an ulnar nerve injury, both of which required surgery. As a result, Tom would not be able to return to full-time heavy labor. A jury verdict close to $1.73 million helped to compensate Tom for his past and future wages, allowing him the financial security to move ahead and retrain for a light-duty job.
